The need for data breach response technology is growing within the K-12 Education market. The Family Educational Rights and Privacy Act (FERPA), a U.S. federal law that guarantees students and their parents a right to privacy of student education records, was passed in 1974 and has since been updated to address the growing threat that cyber attacks pose to privacy.
FERPA 34 CFR Part 99 requires prior written consent before educational institutions can disclose personally identifiable information (PII) from education records. While breach notification is not legally required by FERPA at this time, all 50 states have adopted broader (and increasingly stricter) breach notification requirements that encompass student PII. Further, schools are more frequently electing to notify their communities of breaches in order to maintain trust and allow impacted individuals to safeguard their data.
